AI Chat: Personas, Voice & Art

By downloading, installing, or using the AI Chat: Personas, Voice & Art application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and Vladyslav Nedodaiev ("we", "us", "our"). We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the App. By using the App, you represent that you meet this age requirement. If you are under 18, you must have parental or guardian consent to use the App.
To access certain features, you must create an account using Google Sign-In, Apple Sign-In, or email and password. You agree to provide accurate, current, and complete information during registration.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately if you suspect unauthorized access to your account.
You may delete your account at any time from within the App. We reserve the right to suspend or terminate your account if you violate these Terms, without prior notice.
When you delete your account, your published community personalities undergo a 30-day grace period during which they remain available in an anonymized state (author information is removed). After 30 days, all remaining personality data is permanently deleted. Copies of your personalities that other users have already made will continue to exist independently, as described in Section 8A.3. Shared gallery images follow the deletion rules described in Section 8.4.

The App offers Free, Base, and Premium subscription tiers. Feature availability varies by tier.
Subscriptions are billed through Apple App Store or Google Play Store. By purchasing a subscription, you agree to the respective platform's payment terms:
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage or cancel your subscription through your device's App Store or Google Play settings.
Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly. If you believe you were charged in error, please contact Apple or Google support, or reach out to us for assistance.
We may change subscription prices at any time. Price changes will take effect at the start of your next billing period after notice has been provided. Continued use of the App after a price change constitutes acceptance of the new price.
Free-tier users are subject to usage limits including, but not limited to, message quotas, image generation limits, and feature restrictions. Free-tier users will see advertisements. These limitations may change at any time.
The App uses third-party AI models (currently OpenAI) to generate responses, images, and transcriptions. AI-generated content is produced by automated systems and:
We do not guarantee the accuracy, completeness, reliability, or suitability of any AI-generated content. You use AI-generated content at your own risk and are solely responsible for any decisions or actions based on it.
We reserve the right to change, add, or remove AI providers at any time without prior notice. This may affect the quality, style, or capabilities of AI-generated content.
You agree not to use the App to:
We reserve the right, but have no obligation, to monitor, review, or remove any content generated through or shared via the App. We may take action against users who violate these Terms, including content removal, account suspension, or permanent ban.
If you encounter content or behavior that violates these Terms, please report it to vladislavnedodaiev@gmail.com.
If you choose to share AI-generated images in the community gallery, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and make your shared images available to other App users. This license terminates when you remove the image or disable public sharing.
Shared images are visible to all App users and are associated with your display name and the prompt used to generate them. Consider this before sharing.
Shared images must comply with the Acceptable Use Policy in Section 7. Images that violate these standards may be removed without notice.
Images shared by free-tier users are automatically removed after 7 days. Premium users' shared images remain available until manually removed or until the account is deleted.
The presence of user-shared content in the gallery does not constitute our endorsement of that content.
The App allows you to create custom AI chat personalities with custom names, descriptions, system instructions, welcome messages, and avatar images. If you choose to publish a personality to the community, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, reproduce, and make your published personality available to other App users. This license continues for as long as the personality remains published, and terminates when you unpublish or delete the personality (subject to the copy and deletion provisions below).
Published personalities are subject to automated content moderation. We use automated systems to review personality content (name, description, and system instructions) for compliance with our Acceptable Use Policy (Section 7). Personalities that are flagged by our moderation systems may be automatically rejected or removed. We reserve the right to remove or restrict any published personality at our sole discretion, without prior notice. Repeated violations may result in the suspension or termination of your publishing privileges or your account.
Other users may copy your published personalities for their personal use. When a personality is copied:
By publishing a personality, you acknowledge and accept that other users may copy it and that such copies will persist independently.
Community personalities are provided by individual users and may become unavailable at any time — for example, if the author unpublishes or deletes the personality, if the author's account is deleted, or if the personality is removed for policy violations. We do not guarantee the continued availability, quality, or accuracy of any community personality. If a community personality you are using becomes unavailable, the App will automatically switch the affected chat to a default personality.
The presence of user-published personalities in the community does not constitute our endorsement of their content, behavior, or suitability for any purpose. Community personalities are created by users and may produce unexpected, inaccurate, or inappropriate AI responses. You use community personalities at your own risk.
The App sends your messages and prompts to third-party AI providers for processing. By using the App, you consent to this data transfer. The processing of your data by third-party AI providers is subject to their respective terms and privacy policies.
If you connect your Google Calendar, you authorize the App to read and write calendar events on your behalf. You can revoke this access at any time through your Google account settings.
Sign-in through Google or Apple is subject to the respective provider's terms of service.
Free-tier users will see advertisements provided by Google AdMob. Ad content is determined by Google and is subject to Google's advertising policies. We are not responsible for the content of third-party advertisements.
The App may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party services.
The App, including its design, code, features, trademarks, and all related intellectual property, is owned by Vladyslav Nedodaiev and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.
If you provide suggestions, ideas, or feedback about the App, you grant us a non-exclusive, perpetual, irrevocable, royalty-free license to use, modify, and incorporate such feedback without any obligation to you.
We respect the intellectual property rights of others and expect our users to do the same. If you believe that content available through the App infringes your copyright, please notify us with the following information:

We reserve the right to terminate accounts of users who are found to be repeat infringers.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
THE APP IS NOT A SUBSTITUTE FOR PROFESSIONAL ADVICE. AI-GENERATED CONTENT SHOULD NOT BE USED AS THE BASIS FOR MEDICAL, LEGAL, FINANCIAL, OR OTHER PROFESSIONAL DECISIONS.
WE DO NOT GUARANTEE THAT THE APP WILL BE AVAILABLE AT ALL TIMES OR THAT IT WILL BE FREE FROM ERRORS, BUGS, OR INTERRUPTIONS. WE RESERVE THE RIGHT TO MODIFY, SUSPEND, OR DISCONTINUE THE APP (OR ANY PART OF IT) AT ANY TIME WITHOUT NOTICE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VLADYSLAV NEDODAIEV BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS ($50), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Vladyslav Nedodaiev from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to:
These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through the competent courts of Ukraine.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
We may modify these Terms at any time by posting the revised Terms within the App. We will notify you of material changes through an in-app notification. Your continued use of the App after the effective date of any changes constitutes your acceptance of the updated Terms.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.
We may assign or transfer our rights and obligations under these Terms without your consent. You may not assign or transfer your rights or obligations without our prior written consent.
